Acceptable Use Policy

This Acceptable Use Policy defines the rules governing the proper, lawful, and responsible use of the FencingMonitor Service.

1.Purpose of This Policy

  • 1.1This Acceptable Use Policy defines the rules governing proper, lawful, responsible use of the FencingMonitor Service.
  • 1.2The purpose of this Policy is to protect the security and integrity of the Service, prevent misuse of artificial intelligence systems, ensure lawful use, and protect the rights of users and third parties.
  • 1.3This Policy applies to all users accessing or using the Service, whether as consumers, athletes, coaches, clubs, business users, administrators, or visitors.

2.Service Operator

3.General User Responsibilities

  • 3.1Users must use the Service lawfully, responsibly, in good faith, and in accordance with applicable laws and regulations.
  • 3.2Users may upload only content that they have the legal right to upload, process, and submit for analysis.
  • 3.3Where uploaded content includes identifiable persons, including minors, athletes, coaches, opponents, referees, or spectators, users must ensure that all required permissions, notices, consents, parental authorizations, or other lawful bases exist where required by applicable law.
  • 3.4Users must not misrepresent their identity, authorization, relationship to uploaded content, or legal right to use the Service.
  • 3.5Users must comply with applicable economic sanctions, trade restrictions, export-control requirements, and other mandatory laws governing access to or use of the Service.

4.Prohibited Content

  • 4.1Users must not upload, submit, transmit, or attempt to process content that is illegal, unlawful, deceptive, fraudulent, defamatory, abusive, or malicious.
  • 4.2Users must not upload content that infringes intellectual property rights, violates privacy rights, image rights, personality rights, confidentiality duties, or other rights of third parties.
  • 4.3Users must not upload content containing malware, malicious code, exploit payloads, unauthorized surveillance material, or content intended to disrupt the Service.
  • 4.4Users must not upload, submit, or use the Service in connection with content that sexually exploits, sexualizes, abuses, endangers, or otherwise harms a minor.
  • 4.5Users must not upload or process sexually explicit, exploitative, coercive, or abusive content, or content depicting non-consensual conduct.
  • 4.6Users must not use the Service to promote discrimination, hatred, harassment, or harm against persons or groups based on race, ethnicity, nationality, religion, disability, sex, gender, sexual orientation, or another characteristic protected by applicable law.
  • 4.7Users must not upload or use content that encourages, promotes, celebrates, or facilitates real-world violence, physical harm, or damage to persons or property.
  • 4.8Lawfully recorded footage of fencing as a regulated sport does not, by itself, constitute promotion or celebration of violence or physical harm.
  • 4.9Content must not be fraudulent, deceptive, predatory, or intended to facilitate unlawful or abusive conduct.
  • 4.10The Provider may remove, restrict, or refuse content where operationally appropriate and subject to applicable law.

5.Prohibited Technical Activities

  • 5.1Users must not attempt unauthorized access to servers, systems, accounts, APIs, storage locations, administrative areas, or non-public infrastructure.
  • 5.2Users must not bypass authentication, exploit vulnerabilities, interfere with system integrity, conduct denial-of-service attacks, overload infrastructure, or introduce malicious software.
  • 5.3Users must not test, scan, probe, or attack the Service except where expressly authorized in writing by the Provider.

6.AI System Misuse

  • 6.1Users must not misuse the Service’s artificial intelligence systems, analysis engines, computational methods, prompts, safeguards, AI explanation request functionality, or generated outputs.
  • 6.2Prohibited conduct includes attempts to extract, replicate, reverse engineer, bypass, manipulate, or reconstruct AI models, prompts, proprietary algorithms, datasets, internal rules, Video Analysis consumption logic, request counters, or technical infrastructure. Any restriction on reverse engineering applies only to the extent permitted by applicable law and does not limit conduct that mandatory law expressly permits.
  • 6.3Users must not perform prompt injection attacks, automated output scraping, systematic extraction of Service outputs, or creation of datasets derived from Service outputs for competing AI systems.
  • 6.4Users must not use AI explanation requests in an abusive, automated, excessive, repetitive, or non-human pattern that is inconsistent with normal report consultation.
  • 6.5Users must not present, market, rely on, or redistribute Outputs as guaranteed correct, complete, authoritative, professional, medical, coaching, refereeing, legal, safety, or performance-improvement advice. Metric labels, metric states, and comparative outputs must be treated only as software-level descriptions of measured movement data and must not be presented as classifications or categorizations of an athlete as a person, talent, competitive level, potential, eligibility, or future performance.
  • 6.6Users must not use FencingMonitor outputs or processing capabilities for biometric identification, facial recognition, surveillance, inference of sensitive attributes, medical diagnosis, assessment of health or safety, person-level classification, or automated, sole, or determinative decisions producing legal or similarly significant effects.
  • 6.7The Service’s AI systems, outputs, counters, request logic, and related computational methods may constitute proprietary technology protected by intellectual property law, contract, trade secret, and related legal protections.

7.Automated Access

  • 7.1Users must not use bots, crawlers, scrapers, automated scripts, or other automated access methods without permission.
  • 7.2Automated access is prohibited where it exceeds normal human usage patterns, bypasses access restrictions, harvests data, triggers repeated AI explanation requests, overloads infrastructure, or interferes with Service operation.
  • 7.3Users must not automate report explanations, follow-up questions, progress-related views, versus or comparative views, alternative explanations, regenerated interpretations, or similar AI-triggered actions.
  • 7.4The Provider may apply rate limits, anti-abuse controls, automated blocks, usage counters, and other protective measures where appropriate.

8.Usage Limits and AI Request Counters

  • 8.1Users must not bypass, manipulate, reset, share, pool, resell, or circumvent package limits, AI explanation request counters, Video Analysis consumption logic, access controls, rate limits, or other usage-governance mechanisms.
  • 8.2Users must not attempt to obtain unlimited AI interaction, unlimited regeneration, or general-purpose AI access through purchased video packs or AI explanation request allowances.
  • 8.3Users must not resell, repackage, sublicense, or present FencingMonitor outputs or AI explanation functionality as a separate unlimited AI service or as unrestricted AI access for third parties.
  • 8.4Users must not share accounts, credentials, purchase access, or package entitlements in a way that enables unauthorized, excessive, abusive, or non-human use.
  • 8.5The Provider may count, limit, delay, refuse, suspend, or block AI explanation requests or related processing where use appears excessive, automated, abusive, fraudulent, technically harmful, or inconsistent with normal report consultation.

9.Payment, Merchant of Record, and Entitlement Abuse

  • 9.1Users must not misuse checkout, billing, payment, invoicing, refund, chargeback, tax, or entitlement mechanisms connected with the Service.
  • 9.2Users must not use stolen, unauthorized, false, misleading, or fraudulently obtained payment details, billing details, account details, tax information, VAT information, company information, or identity information.
  • 9.3Users must not attempt to bypass, manipulate, interrupt, reverse, or exploit payment processing, Paddle checkout flows, Paddle-managed billing, invoice generation, tax calculation, refund workflows, chargeback processes, or Merchant of Record controls.
  • 9.4Users must not falsely claim non-delivery, technical failure, unauthorized use, consumer status, business status, billing identity, location, tax status, or entitlement status in order to obtain unauthorized refunds, service allowances, access, or payment advantages.
  • 9.5Users must not resell, transfer, pool, sublicense, share, or commercially exploit purchased packs, video-analysis entitlements, AI explanation request allowances, or account access except where expressly permitted by the Provider.
  • 9.6The Provider may restrict, suspend, terminate, investigate, or refuse service where payment abuse, entitlement abuse, refund abuse, chargeback abuse, tax abuse, fraud, or misuse of Merchant of Record processes is suspected, subject to applicable law and payment-provider rules.

10.Use of User Content

  • 10.1Users remain responsible for all content they upload, submit, or cause to be processed through the Service.
  • 10.2Business users, clubs, coaches, and organizations are responsible for ensuring compliance with applicable data protection, privacy, employment, sport, child-protection, image-rights, and consent rules when uploading content involving third parties.
  • 10.3The Provider does not state that it independently verifies all permissions, consents, or lawful bases behind each upload.
  • 10.4The Provider may restrict or remove content where legal authority to upload or process that content is disputed, unclear, or credibly challenged.
  • 10.5A video rejected solely because it does not meet technical recording or processing requirements is technically ineligible; that technical ineligibility does not, by itself, constitute a violation of this Policy.

11.Lawful Sharing and External AI Use

  • 11.1Users may lawfully share their own report with the athlete, a parent or guardian, a coach, or a club, provided that privacy, confidentiality, image rights, and third-party rights are respected.
  • 11.2Users may copy their own FencingMonitor report into an external AI service of their choice for broader discussion. The external service and its responses are independent of FencingMonitor and are subject to that service’s terms and privacy practices.
  • 11.3Users must not disclose personal data, a minor’s information, confidential material, or third-party content to an external AI service without the authority and lawful basis required for that disclosure.
  • 11.4Permitted sharing does not authorize scraping, systematic extraction, mass automation, creation of a competing dataset, training of a competing service from FencingMonitor outputs, resale, sublicensing, or repackaging of outputs as a separate AI or professional service.

12.Service Security

  • 12.1The Provider may implement technical and organizational security measures, including access controls, monitoring systems, automated abuse detection, fraud-prevention tools, rate limits, and system integrity checks.
  • 12.2Users must not circumvent, disable, interfere with, or mislead these security measures.
  • 12.3This Policy does not promise continuous real-time monitoring, exhaustive screening, or guaranteed abuse detection unless such capabilities are actually deployed and expressly disclosed.

13.Consequences of Policy Violation

  • 13.1Violation of this Policy may result in warning, removal of content, refusal to process content, suspension of access, account restriction, account termination, Video Analysis restrictions, AI explanation request restrictions, investigation, or other protective action.
  • 13.2The Provider may reduce, suspend, block, refuse, or throttle AI explanation requests, follow-up requests, regenerations, automated activity, or related processing where this is necessary to protect the Service or enforce package limits.
  • 13.3Enforcement may vary depending on the nature, severity, repetition, intent, risk profile, operational impact, and legal context of the violation.
  • 13.4The Provider may take additional legal action where appropriate and necessary to protect the Service, users, third parties, infrastructure, intellectual property, contractual rights, or legal obligations.
  • 13.5Enforcement measures will be proportionate to the nature, seriousness, repetition, intent, risk, and actual or potential impact of the violation.
  • 13.6Where appropriate, legally permitted, and compatible with security or fraud prevention, the Provider may give notice and a reasonable opportunity to remedy a remediable breach before permanent termination. Immediate action may be taken where required by law or reasonably necessary to address unlawful activity, fraud, security threats, harm, or material risk.

14.Reporting Violations

  • 14.1Users who become aware of suspected violations may report them by contacting the Provider.

  • 14.4The Provider may investigate reported violations and take action where appropriate.

16.Policy Updates

  • 16.1This Acceptable Use Policy may be updated periodically to reflect legal, operational, technical, security, vendor, or product changes.
  • 16.2Users will be informed of material updates where required by law.
  • 16.3Continued use of the Service after updates take effect may constitute acceptance of the revised Policy to the extent permitted by applicable law.
